State Appeals Rejection Of Disciplinary Action Against UI Doctor

IOWA CITY, Iowa (AP) State regulators are appealing a ruling that threw out disciplinary action against a University of Iowa doctor they accused of abusing alcohol.

The Iowa Board of Medicine announced last week that it would ask the Iowa Supreme Court for further review of last month's appeals court ruling in the case of neuroradiologist Wendy Smoker. The high court doesn't have to take the case.

The ruling criticized the board for conducting a "blatantly subpar investigation" into allegations that Smoker, a recovering alcoholic, had resumed drinking.

The court said the board unfairly cited Smoker for alcohol use despite having no evidence that her ability to practice medicine was compromised by a 2009 relapse in which she drank wine at a professional dinner.

The ruling threw out a five-year probation period for Smoker.
