Northwest Iowa Man's Murder Charge Dropped
SPENCER, Iowa (AP) - A prosecutor says a murder charge filed against a Spencer man has been dropped because a witness lied.
Sioux City television station KTIV says Cody Millard had pleaded guilty to a felony drug charge and a misdemeanor. The 22-year-old and another man, Christopher Fitzpatrick, were charged with murder and other charges after 59-year-old Edward Kitto died Sept. 8, 2012. Kitto was beaten Aug. 27 and found in the backyard of a Spencer home. Fitzpatrick admitted hitting Kitto and stealing money from his wallet. Fitzpatrick made a plea deal and is serving a 45-year sentence.
Clay County Attorney Michael Houchins says Millard's charges were changed because a witness against Millard has admitted lying to officers. Houchins did not name the witness.
Millard's sentencing is scheduled for Dec. 2.
