Man Convicted in Crash Wants Judgement Thrown Out

    MASON CITY, Iowa (AP) - A Mason City man convicted in connection with the killing of a man in a 2012 traffic accident is seeking to have his judgment and sentence thrown out.

    The Globe Gazette newspaper reports 34-year-old Jason Glenn Genzler has filed an application in district court seeking the post-conviction relief.

    Genzler pleaded guilty to homicide by vehicle for the early-morning May 12, 2012 crash that killed 33-year-old John Matthew Lybarger, of Mason City.

    Police say Genzler was driving the pickup went out of control around 3 a.m., entered a ditch, rolled and came to rest upside down.

    Lybarger was taken to a nearby hospital, where he died.

    Genzler claims his attorney didn't properly investigate and defend him and that the victim may have contributed to his own death.
