Dyersville Citizens Group may Proceed with Lawsuit

DES MOINES, Iowa (AP) - The Iowa Court of Appeals says a group of Dyersville citizens may move forward with a lawsuit against the city as the group tries to block a zoning change that would turn farmland into a baseball complex around the "Field of Dreams" movie site.

A group of 21 citizens filed a lawsuit last year asking a judge to halt city plans to rezone land from agricultural use to commercial.

Group members say they don't oppose the project but don't want good farmland used for it.

In October 2012 a judge declined to stop the rezoning, concluding the City Council did nothing illegal.

The committee appealed. The appeals court on Wednesday says the judge had improperly dismissed the petition and sent the case back to the judge for further proceedings.
