New Details in Rep. Kerry Burt Drunk Driving Arrest

ANKENY - A state representative from Waterloo tells Ankeny police that on the night he was arrested on suspicion of drunk driving, he had been drinking while at a party with Governor Chet Culver.

Burt was arrested in Ankeny on Feb. 11, allegedly with a blood-alcohol level of 0.129 percent, which is above the legal limit of 0.08 percent. The Ankeny Police Department report also indicates Burt told officers he couldn't be arrested because he was a state legislator.

Police asked Burt how much had he to drink and according to the police report, responded, “It’s not so much how much I had to drink, but who I was drinking with.” According to the report, Burt then whispered to the officer, “the governor."

Later the report states that Burt told police he could call three people to get him out of jail; Speaker of the House Pat Murphy, Iowa Department of Public Safety Communications Director Courtney Greene or Department of Public Safety Commissioner Gene Meyer.

The arrest caused Burt to lose his driver’s licenses and his position as a firefighter in Waterloo.

Burt’s trial has been delayed until August to give a judge time to consider a motion to suppress evidence. Burt allegedly failed a chemical breath test, but an associate judge ruled police should have informed Burt his commercial driver’s license could be revoked before the test.
