DES MOINES (AP) - The trial of an Iowa lawmaker accused of drunken driving, that had been scheduled to begin this week, has been delayed until August.
Rep. Kerry Burt was arrested in Ankeny on Feb. 11. A police report indicates Burt's blood-alcohol level was 0.129 percent, above the legal limit of 0.08 percent.
Burt's trial was originally scheduled for June 1, but was continued to give a judge time to consider a motion to suppress evidence.
Associate Judge Odell McGhee threw out the results of a chemical breath test Burt allegedly failed. McGhee ruled police should have informed Burt his commercial driver's license could be revoked.
Burt was elected to his first term in the Iowa House in November. He was laid off from the Waterloo Fire Department after losing his drivers license.
