Motion Denied in Grave-Digging Case

GRANT COUNTY, Wis. - A Grant County Circuit Court judge has denied a prosecutor's motion in the case of Nicholas Grunke, 23. Grunke is accused of trying to dig up a grave so he could have sex with a corpse.

The Telegraph Herald reports that prosecutors claimed Grunke was motivated by the lyrics of death metal band Cannibal Corpse. The judge said there was no evidence of this.

In September, 2006 police found Grunke, his brother Alex, and their friend Dustin Radke near a cemetery in Cassville, Wisconsin.

Radke told police Grunke wanted to have sex with a woman who had died in a motorcycle crash one week earlier.

His trial is scheduled to start in July.
