INDEPENDENCE - A judge will now decide if a Coralville woman accused of killing one son and trying to kill another can continue to get jail visits from her husband.

Michelle Kehoe is charged with first degree murder, attempted murder and child endangerment. She is accused of killing her two-year-old son Seth in rural Buchanan County last October. She also faces attempted murder charges for cutting the throat of her seven-year-old son Sean.

A judge in Buchanan County approved a no contact order last week. It keeps Kehoe from having contact with her surviving son and other family members. In court Tuesday, Kehoe's attorney argued that Eugene Kehoe wishes to keep visiting his wife in Buchanan County jail. And Kehoe's attorney asked the judge to modify the earlier order so Eugene Kehoe can maintain contact if he wishes. Kehoe's attorney says there has been no harassment or threats resulting by visits from the defendant’s husband and it is their decision to maintain that contact.

However prosecutors say state rules require a no contact order to include members of the victim's family for good reasons. One prosecutor said he couldn't disagree more with no possible harm because the child would know the father is seeing the woman who attempted to slice his throat. The judge has not indicated when he would make a decision on this request.

Also Tuesday, Michelle Kehoe's trial was set for October 28th.
