Questions Remain in Dyersville Shooting Death

Dubuque County - Dubuque County Attorneys won't say why they have not charged a Dubuque man for the shooting death of 24-year-old David Herman.
Investigators say a locksmith working at the Bon Jour Apartments in Dyersville shot and killed Herman.
That was during a fight on Saturday.

Officials say the man had a permit to carry a concealed weapon.

There's a burning question still unanswered in the Dyersville neighborhood.

Dubuque County Sheriff’s Captain Bob Lynn said, "The main question involving the whole case is, was this individual justified in using the force he chose to use to protect himself?"

For Dave Herman's friend and neighbor, Curtis Savage, the answer to that question has to be no.
Savage said, "He was the kind of guy who would give you the shirt off your back. I have never seen him in a mean state."

Savage says the shooting has shocked the neighborhood.

Savage said, "we fear for our safety because we don't know whose coming into our house with what type of work it’s suppose to be one of those maintenance people and he is carrying a gun."

Deputies say the locksmith shot Herman in the chest, after Herman followed him to his car.

Savage admits he doesn't know all the details, but says to him it seems the locksmith aimed to kill.

Savage said, "To me he was like a big Santa Claus and for him to have killed like that out there proves me that nobody is safe."

The Dubuque County Attorney, Ralph Potter, met with investigators today.
But told TV-9 he has no comment at this time.
The shooter's name in not being released.
