DYERSVILLE - The Dubuque County sheriff's office is still investigating what led to a Dyersville man's death. Deputies say a 48-year-old Dubuque man who was working on 24-year-old David Herman's apartment shot and killed Herman Saturday afternoon.

The sheriff's office says David Herman was evicted from his apartment. Saturday afternoon, a maintenance worker changed the locks on his apartment. When Herman came to get a few items from his home, he noticed his key didn't work anymore, and deputies say he confronted the repairman who was working on another unit at the time.

They got into an argument that eventually turned into a physical fight. Then the sheriff's office says the maintenance man went out to his car and got a gun. Investigators say he shot Herman through the heart and killed him.

" We have several witnesses. Some, based on what they saw, feel the individual who fired the shot was in danger. Others didn't quite see it that way," says Captain Bob Lynn of the Dubuque County Sheriff's Office.

The sheriff's office tells TV9 News the repair worker did have a concealed weapon permit. Monday, the sheriff's officials will present its evidence to the county attorney, who will decide whether to press charges. They are not releasing the maintenance man's name until a decision is made about charges.

Herman leaves behind a fiancee and three small children. Sunday night, she sat down with KCRG-TV9 to tell us more about him.

Jeannette Fauver said David Herman loved to hunt, fish and play with his children. She still can't believe he's gone.

Fauver's world collapsed when her fiance, David Herman, got shot and killed outside their apartment.

"I think I'm still in shock. It's kind of sunk in a little bit, but it's kind of surreal. It just doesn't feel real to me,” Fauver said.

Fauver has dated Herman for seven years. They had one daughter, Delilah, but Herman treated Fauver's other two children as his own.

"He was a really good protector. He tried to do the best for his family,” Herman’s stepdaughter Chloe Usher said.

Herman’s other stepdaughter, Ashley Usher, said, "He was a really good dad. This year he was going to take us sledding, but it was too late because he died. "

Fauver's not sure if the children truly realize what happened. She's still trying to understand everything herself.

"I miss lying next to him at night, talking to him every day…just everything about him…his whole personality…his warmth and his kindness,” she said.

Fauver and Herman planned to get married early next year. Now the young mother is planning a funeral instead.

"I loved him very much and I don't think I could ever love anyone as much as I loved him," Fauver said.

Investigators asked Fauver not to talk to the media about the shooting itself because they're still collecting evidence.

But she did want to share a few memories about her late fiance.
