DYERSVILLE - The Dubuque County Sheriff's Office says the man shot and killed Saturday was David Herman, 24. The Dyersville man died from a single gunshot wound.
Authorities say around 2:00 p.m. Saturday, they were called to an apartment complex in the 500 block of 9th Street in Dyersville.
They say it appears a maintenance man fired two shots, one causing the fatal wound.
The circumstances leading up to the shooting are still under investigation. Police say the 48-year-old Dubuque man was taken into police custody and interviewed before he was released. Authorities say the man is cooperating with the investigation. They have not released his name.
People who knew the victim say the man lived with a woman and her children. They were in the process of being evicted and returned to the complex to celebrate Thanksgiving with friends and move out their last belongings.
No arrests have been made and no charges have been filed.
The Dubuque County Attorney's office advised that no charges are filed because they need further investigation on whether it's a justifiable shooting.
