Court Rules on Iowa Medical Malpractice Case

DES MOINES (AP) - The Iowa Supreme Court is sending the case of a woman who sued her doctors for failing to diagnose breast cancer back to a lower court for more proceedings.
In her lawsuit filed in Scott County District Court, Pamela Rock claims the doctors' negligence caused the cancer to spread to her lymph nodes.
Rock claims in the lawsuit filed in October 2004 that doctors failed to properly examine, diagnose and treat the cancer in her left breast, and instead examined her right breast.
In its ruling Friday, the Supreme Court rejects the defendants' argument that Rock's lawsuit wasn't within the two-year statue of limitations. They had argued that Rock should have known of her condition in September 2002 when a doctor told her initial testing of the breast wasn't normal.
