Unfortunately, this defense may work, to a degree. I knew of someone who stopped taking their epilepsy meds, and had a seizure, while driving. He crossed the center line, and took out four lives. He only served a little over two years in prison, for four consecutive involuntary man-slaughter charges. This drunk plea is the reversal of this situation. Instead of NOT taking something to prevent deviation, this individual DID take something. He may have more of a chance than what you'd think-

i beg to differ with the person that said, " ...drink and drive, kill someone and get life." that's funny, AND not true. my little family has been the victim of drunk drivers on 2 seperate occasions. 1 year at the Larry Nelson Ctr was the worst punishment handed out, and yes, there was a death involved. to excuse ANY crime on the grounds of intoxication is a crime in itself. people make the choice to drink, then expect to have bad behavior excused because they had too many? pretty crooked system

I've been really drunk many times, and I have never once done anything violent. Drinking has gotten me into trouble, but I took responsibility for my actions, because I was the one who chose to drink. I even got pregnant while I was drunk... he's a freshman at Coe college because I took responsibility for my actions instead of making excuses. There's something wrong with kids who think they're entitled or think they don't have to be responsible for their actions.

The kid didn't intentionally kill the guy. If you were to know the story he accidentally ended up in the guys apt, and he hit him in just the right spot. Read his records, he's clean as can be. His friends said he didn't even drink. It was an unlucky night where he got confused because he was lost(NOT FAMILIAR WITH IOWA CITY) and startled that some man was hovering over him. I don't think he's innocent, but you should look into the story before leaving ignorant comments!

Whoopie ! Every body wins. The prosecutor gets a CONVICTION for his / her records, the perpetrator gets off with a slap on the wrist and every body except the VICTIM is fine. What a poor state when someone can walk away from a crime because of intoxication.

If you feel that this is all you can do is go out, get drunk and then think oh, then let's go kill someone, then by all means, check yourself into a mental ward and then this way, no murder charges can be pinned on this person and they will have to complete a drug rehab and go to classes. We've all gotten drunk and done stupid things. It was on his 21st birthday, a lot of bars will give you free drinks and stuff so maybe he really was just in a drunken blackout or something. Judgements are best made by... wait for it... JUDGES! I'm sure that not all the facts of this case are known. He might have thought it was a freinds apartment or something and gotten attacked by this guy. Probably just an accident.
