Trial in Clear Lake Wet T-shirt Case Delayed

CLEAR LAKE (AP) - The trial of a Clear Lake businessman accused of violating the city's adult entertainment ordinance by sponsoring a wet T-shirt contest has been delayed.

Alan Slater is the co-owner of The Marina and he was cited on June 16 after he held the contest at his business without a permit. He pleaded not guilty to the charge.

Trial was scheduled to begin Thursday in Cerro Gordo County District Court but a judge postponed the proceedings to consider four constitutional challenges filed by Slater's attorney, Phil Redenbaugh.

Redenbaugh claims the city's adult entertainment ordinance is unconstitutionally vague and infringes on Slater's First Amendment right to free expression. Redenbaugh also says he plans to claim that Slater is the victim of entrapment.

A hearing on the challenges is scheduled for Nov. 12.
