Man Arrested For Throwing M&Ms at OfficerDES MOINES (AP) - A 20-year-old Des Moines man is charged with assaulting a police officer - with candy. Officials say Sean McGuire, a student at Drake University, was arrested early Sunday at a convenience store. He allegedly threw several M&M's at a Des Moines police officer, who was investigating a hit-and-run accident involving an intoxicated man. Police reports say Drake security guards on the scene noticed M&M candies falling on the ground around the officer. When the officer turned around one of the candies hit his shoulder. McGuire claimed he threw the candy because he was "sticking up for his friend," who apparently was the man suspected in the accident. |

I cannot believe how many are blaming the cop. This kid was in the wrong and being a buttwipe, period. How many of you would be proud to have this punk as your child, he is 20 acting 5. If it were a little kid I think the cop would have reacted differently but this was blantantly attacking a cop, whether it is throwing candy or rocks there is no difference. I saw take this punk out back of the court house and spank his rear raw with a cane then he may learn to behave.

Cops just dont like to do follow thru with upholding the law anymore unless its something idiotic like this. I watch people litter, speed, even crash, yes I said crash in front of police and they go on doing their own thing. I have no respect for the police anymore. The days of repectable police officers are gone, We are stuck with the "short mans syndrome" officers that think they need to prove how tuff they can be.

What is sad is so many people commenting that the police overreacted. It shows quite the immaturity of this nation when someone would be stupid enough to do that, and then people would be ignorant enough to not see the problem with him doing it. Assualt is assualt, irregardless of what is used. No he wasn't in life danger, but had he been from something more dangerous, he could have used more aggressive force. My hat is off to the officer.

It's not just the M&M's that some seem to think it is. Where do you draw the line in throwing anything at a police officer? Starburst (as was suggested), Snickers bars, cartons of ice cream, bullets? I'm sure the cop told the person to knock it off. Wasn't listened too, turned around and was hit in the chest. What if the person was trying to get his attention to do something more devious? The cop was very much in line for arresting the thrower of candy.

Obiously Mr C doesn't understand all that police deal with. When you're already dealing with one drunk, especially a hit and run suspect, then have his friend throwing stuff at you, it is better to get him in cuffs as well for the officer's safety. If you are causing a distraction while an officer is doing his job, it is at least, interference with official acts. He did not abuse his authority, he used it to control a situation before. Yes it's assualt since he was using the candy as a weapon

That must have been one very delicate police officer. "Assault" is really stretching the law, here. Why not arrest him for attempted murder while they're at it? If a normal citizen had been hit with an m&m, no police action would have been taken. Cops need to think of themselves as citizens, not as gods. The best charge that fits these circumstances is "interference with official acts" because that's what the suspect actually, allegedly did.

708.1 Assault defined. A person commits an assault when, without justification, the person does any of the following: 1. Any act which is intended to cause pain or injury to, or which is intended to result in physical contact which will be insulting or offensive to another, coupled with the apparent ability to execute the act. best to know the laws. It only needs to be offensive or insulting. Would it be amusing if had squirted him with a watergun that looked real? Imagine the results.

You simply cannot throw something at a cop. Period. Candies or rocks. Why is that so hard to comprehend? They are not to be subjected to having anything thrown at them, or you will be arrested. Sure it is a comical event, but the bottom line is that it was childish and therefore anyone defending it as something to be overlooked despite the law certainly reveal their own juvenile viewpoint.
