CHARLES CITY, Iowa - A Charles City teenager found guilty of sexual abusing and killing his three-year-old cousin is appealing his conviction.

In November, Edgar Concepcion Jr., 15, was sentenced to two life terms in prison, plus 30 years, after being convicted in June of murder, sexual abuse and child endangerment in connection with the death of his cousin, three-year-old Krystel Banes, in July of 2009. Concepcion was tried as an adult.

According to the Waterloo-Cedar Falls Courier, Concepcion's attorney, Judy O'Donohoe, filed the appeal on November 23 saying life in prison without parole was cruel and unusual punishment for a juvenile. The Courier reports that O’Donohoe also requested the court appoint a public defender to handle the appeal.

Concepcion is currently being held at the Iowa Medical and Classification Center in Oakdale until prison officials decide where he will serve out his sentence.
