Shawn Bentler Files Motion for New Trial

KEOSAUQUA (AP) - Shawn Bentler wants a new trial.

The Quincy, Ill., man, was convicted last month of killing his parents and three sisters at their home near Bonaparte.

In a motion for a new trial, Bentler's attorneys cite in part the use of a 911 call that came from the family's home.

A judge set a hearing for Tuesday in Van Buren County District Court -- the same day Bentler is to be sentenced on five counts of first-degree murder for the October 2006 shooting spree.

Prosecutors say Bentler coldly and systematically carried out the slayings to gain control of his parent's nearly $3 million estate.

Prosecutors focused on a 911 call. It begins with his sister, Shayne, saying her older brother was “going to do something,” followed by the sound of his mother screaming, a gunshot and a scream “Shawn, no!” before the line goes dead.

In the motion, defense attorneys argue the use of the 911 call violates Bentler's constitutional right to confront his accuser and was hearsay.
