Judge moves Marion kindergarten teacher's trial

CEDAR RAPIDS, Iowa (KCRG-TV9) -- Judge Casey Jones has granted a motion to move the trial of a Marion teacher accused of not reporting sex abuse out of Linn County. Diane Graham was charged in April with one count of failure to report child abuse. Her attorney filed the motion that same month to have her trial moved.

Graham oversaw a a kindergarten classroom at Starry Elementary where her in-classroom volunteer, now 16-year-old Logan McMurrin, sexually assaulted at least three of her students during school hours repeatedly over a period of months.

TV9 reached out to attorney, Mark Spellman, who is representing several victims' families in a civil suit against the school district and Graham, for comment on the move. Spellman said he could was "not able to comment at this time." TV9 also reached out Graham's attorney, Mark Brown, and we are still waiting to hear back.
